The Regional Court of Augsburg has acquitted those responsible for the "Embryo Donation Network" because the actions they were accused of did not constitute criminal offences against the Embryo Protection Act. The acquittal is certainly positive from a legal-political point of view, but the court's argumentation is not convincing. Above all, the interpretation of the court could have far-reaching effects on the entire reproductive medicine in Germany - which the court certainly did not consider and certainly did not want.
Kurzfassung: Das Landgericht Augsburg hat Verantwortliche des „Netzwerks Embryonenspende“ freigesprochen, weil die ihnen vorgeworfenen Handlungen keine strafbaren Verstöße gegen das Embryonenschutzgesetz darstellten. Der Freispruch ist rechtspolitisch betrachtet sicher positiv, die Argumentation des Gerichts überzeugt dagegen nicht. Vor allem könnte die Interpretation des Gerichts weitreichende Auswirkungen auf die gesamte Fortpflanzungsmedizin in Deutschland haben – was das Gericht sicherlich nicht bedacht und auch sicherlich nicht gewollt hat.
